Over the past three days we've been treated to Hilaria's pap walks - I mean, someone in that $16 million dollar apartment, staffed with nannies and God knows how many assistants, has to go out and get the coffee, am I right? - wearing $300 slippers and another sweatshirt reading 'HUMAN' and on Monday, a hot pink hoodie reading 'BOUNDARIES ARE HOT.' Know what else is hot? A criminal justice system unbowed by celebrity. No matter how this trial plays out, Alec and Hilaria Baldwin are already suffering. They have done themselves deep, irreparable reputational damage, treating the accidental death of a young wife and mother, at Alec's hands, as some kind of tabloid joke. In the days after Hutchins's death, Hilaria posted this: 'Parenting through this has been an intense experience, to say the least.' Alec and Hilaria haven't begun to experience intense. Intense will be that criminal trial in New Mexico. Intense is the very real possibility of going to prison. Intense is trying to sell off all their most valuable real estate - they just price-chopped their beloved house in Amagansett by $4.1 million and are quietly shopping their NYC pad - and moving to Vermont, which isn't really a hotbed of paparazzi. Intense will be losing much of Alec's fortune to legal fees.

I love the sweatshirt she is wearing with “Empathy” printed on it. Why would we empathize over her and Alec’s predicament? I do like the bags under Alec’s eyes. He must be sweating it out and having lack of sleep.

That probable cause statement spoke volumes in what it didn't say when added to his ill considered public bloviating.

To me this looks like one forceful personality bent on getting his way, and in an environment like that there are without doubt a number of sycophants. That's probably the AD and why he took the plea deal. That poor kid who was the armorer, who knows. She may well have done everything right and just been steamrolled. Hopefully her lawyers will sort this out.

But Alec, Alec my boy killed that woman with his ego.

Alec could have immediately put the criminal side of the case to bed if he would give his ego the day off. Go to the prosecutor, offer to take a misdemeanor negligent homicide charge with community service and restitution, everybody gets to claim a win. And if they don't accept, then the overworked and underfunded prosecutor's office gets to fight a wealthy celebrity with an OJ level all star legal team.

Alec Baldwin asks court to DISQUALIFY special prosecutor assigned to his involuntary manslaughter case because she is a Republican lawmaker and her position is 'unconstitutional'

Alec Baldwin has demanded the special prosecutor assigned to his involuntary manslaughter case be disqualified due to her status as a Republican lawmaker.

Baldwin accidentally shot and killed 42-year-old cinematographer Halyna Hutchins after being handed a gun with live ammunition on the set of his film Rust in October 2021.

Andrea Reeb kicked off the prosecution sensationally last month, and flatly declared that if not for the actions of Baldwin and others on set 'Hutchins would be alive today.'

But the Hollywood star, who faces up to five years in jail if convicted, has now said the appointment of Reeb as special prosecutor is 'unconstitutional' because she also serves in the New Mexico House of Representatives.

A motion to the court filed on behalf of Baldwin - a Democrat and vocal Donald Trump critic - says she 'must' be taken off the case, alleging her appointment is a violation of New Mexico's constitution which prohibits the mixing of two branches of government.

The motion, seen by Law and Crime, adds that she could face 'pressure' to make a decision that serves her 'legislative interests'.

The argument is a constitutional one and not politically motivated, his team said.

'Under Section 1 of Article III of the New Mexico Constitution, however, a sitting member of the Legislature may not 'exercise any powers properly belonging' to either the executive or judicial branch,' Baldwin’s attorney Luke Nikas said in the motion.

'As a special prosecutor, Representative Reeb is vested by statute with 'all the powers and duties' of a District Attorney, who is considered to be a member of either the judicial or executive branch of the New Mexico government.

'The legal question is not a close one, she must be disqualified.'

Baldwin is scheduled to make his first court appearance on February 24.

I actually agree with the defense on this point. There shouldn't be any blurring the lines between branches of government and fer goodness sake don't hire somebody who even might have a political agenda, this just gives the defense a handful of aces to play in appeals. Not to mention, it looks super bad in the court of public opinion. Which, has a helluva lot of pull in the legal system whether we want to admit it or not.

I'll take bed pans any day over fast food, just think of it as mucking stalls. My brief tenure at McD's was the grossest and most difficult job I have ever had and those poor bastards deserve $20.00 an hour.

Halyna's family is being represented by Gloria Allred, who is expected to host a press conference later today where more details will be given. Baldwin has been charged with one count of involuntarily manslaughter and is awaiting his first court appearance. awaiting his first court appearance. He previously settled a wrongful death lawsuit filed by Halyna's widower Matthew, making him an executive producer on the movie when it resumed production.

Alec Baldwin claims he's facing bogus weapons charge: Lawyers argue state legislature didn't pass law he allegedly violated until 7 months AFTER he accidentally shot Halyna Hutchins dead

Alec Baldwin and his lawyers are fighting a portion of his involuntary manslaughter charge in the death of 'Rust' cinematographer Halyna Hutchins.

The '30 Rock' actor's lawyers have filed legal documents arguing against the firearms enhancement addition which was not passed by the New Mexico State Legislature until seven months after Hutchins was shot and killed.

An older version of the enhancement was in place at the time but stipulates that a firearm be 'brandished' with the 'intent to intimidate or injure a person,' which Baldwin says he did not have.

Baldwin and 'Rust' armorer Hannah Gutierrez-Reed were both charged with involuntary manslaughter in January as prosecutors cited a 'criminal disregard for safety.'

If convicted with the enhancement, Baldwin and Gutierrez-Reed would get a mandatory five-year sentence.

Another victory for Alec Baldwin as Santa Fe DA who charged him with involuntary manslaughter STEPS DOWN from the case

The Santa Fe District Attorney who charged Alec Baldwin with involuntary manslaughter for accidentally shooting Halyna Hutchins on the set of Rust has stepped down from the case after a series of setbacks.

First Judicial District Attorney Mary Carmack-Altwies made a national name for herself when she zealously charged Baldwin with manslaughter with a sentencing enhancement for using a gun in January, more than a year after the fatal shooting.

But she announced today that she would be replaced by two local attorneys, Kari Morrissey and Jason Lewis.

In a statement, Carmack-Altwies said she chose to stand down in order to focus on other cases in the state.

Her departure comes as Baldwin was slammed on social media for reposting rocker Peter Frampton's gun control message. Alec Baldwin has been criticized on social media after reposting a message about gun control - after his own fatal shooting on the set of movie Rust.

Alec Baldwin's 'Rust' assistant director sentenced in fatal shooting of Halyna Hutchins

"Rust" assistant director Dave Halls was sentenced Friday after pleading no contest to negligent/unsafe handling of a firearm that led to the on-set October 2021 fatal shooting of the film's cinematographer, Halyna Hutchins. Halls entered a plea of no contest to the misdemeanor charge of negligent use of a deadly weapon. Judge Mary Marlowe Sommer accepted the plea. The prosecution requested a suspended sentence, which is a conviction.

Halls' attorney Lisa Torraco argued his sentence should be deferred. Torraco explained that Halls did not have control over how individual people handled safety on the set. "In his mind, he was checking for dummy rounds or blanks," she explained. "He, like many others, is extremely traumatized." Halls is "rattled" with feelings of guilt, she added.

Torraco also emphasized that Halls came in early to the court and pleaded no contest so that everyone can move on and begin processing what happened. However, Sommer was not convinced and gave him a suspended sentence. The assistant director will not serve jail time and instead was given six months of unsupervised probation.

Halls' probation includes testifying truthfully at any trials or hearings, a $500 fine, participation in a firearms safety course with proof of completion within 60 days of his plea, no alcohol, 24 hours of community service and no contact with any potential witnesses or co-defendants. Halls' original hearing was scheduled for March 29. Halls and the district attorney reached the plea agreement on Jan. 20. Halls was one of three people to be charged in connection to Hutchins' death.

Halls allegedly handed Baldwin a .45 revolver, telling him that it was "cold," or safe. Prior to that, Gutierrez-Reed spun the cylinder to show Halls what was in the gun, her lawyer previously said.

Baldwin has maintained that he did not pull the trigger of the gun — once during a primetime interview shortly following the deadly shooting and again on a podcast episode. The actor originally said he had pulled the hammer of the gun back as far as he could and released it, but did not pull the trigger.

Halls' attorney previously claimed the assistant director did not hand off the gun to Baldwin, despite search warrants confirming he had told police he did. "This idea my client grabbed the gun and handed it to Baldwin absolutely did not happen," Torraco said shortly after the shooting during an appearance on "The Story." She later dodged questions during the interview about whether Halls handed the gun to Baldwin, despite Martha McCallum asking whether Halls "doesn't know if he handed the gun to Alec Baldwin."

Recently appointed special prosecutors Kari Morrissey and Jason Lewis are expected to be filing paperwork to dismiss the charges soon.
