A close encounter with the process server!
Hi,
At 2:30 PM Arizona time on Friday, the constable arrived, a burly man of medium-height who was ready to demand that we leave in 15 minutes. A maintenance person came to change the locks.
I protested, explaining that Barbara had major surgery on Tuesday, that she required bed rest and needed to avoid strenuous physical activity.
The constable was handed the discharge materials from the hospital, which he claimed not to believe. He then went on to assert that I had written numerous letters to the community manager and that, strange as it sounds, I also sent a flower truck with flowers for her in an attempt to persuade the complex not to evict us.
At most, I sent several emails explaining Barbara’s physical condition, offering to supply a physician’s letter asserting to her condition, and that was it! This is outrageous!
Perhaps the constable was just lying to us, or was misinformed. I don’t know.
After the constable spoke to Barbara, who was clearly in weakened condition, he agreed to let us stay the weekend. We have to be gone by Monday morning or he will have us forcibly removed. In Arizona, the constable is not just a process server but an officer of the court with wide authority and discretion.
Over the past few days, I contacted several charitable organizations, including a synagogue and a church, and they were not able to provide any help. I suspect they were just overextended.
A lawyer said I have to listen to the constable.
What this means is that we will have to leave regardless. I have already made a reservation at yet another cheap motel.
Where I go from there is anyone’s guess. It will be very difficult to convince another landlord to take us in after this. But I will try.
