Judges ruled that he should go free while his lawyers work on the appeal of his conviction on five felony counts of lying to police about a racist and homophobic attack. He will be released on a $150,000 personal recognizance bond. Smollett, who has been serving his time in psychiatric care, was sentenced to 150 days behind bars.

The trial saw Cook County prosecutors outline to jurors how Smollett paid $3,500 to Abimbola and Olabinjo Osundairo to stage the January 2019 attack in a shameless bid to coax sympathy from the public as an apparent hate crime. The plot came to light after the brothers, a pair of aspiring actors from Nigeria, confessed the mugging was a hoax after nearly two days in a Chicago lockup. Considered the state's star witnesses at the time, the brother's both delivered in-depth testimonies that laid bare the plot, leading to the actor's conviction in December 2021. Smollett, a gay man, has since vehemently denied the charges, even after serving six days of an agree-upon 150 sentence in a Chicago jail. The Illinois Appellate Court ordered a stay on his sentence last March, as he sought an appeal of his conviction.
