'Rust' armorer Hannah Gutierrez-Reed asks judge to dismiss involuntary manslaughter charges as she accuses prosecutors of 'sloppy' investigation and claims her case is 'tainted by improper political motives'

Hannah Gutierrez-Reed, the armorer on the film set in which Alec Baldwin shot dead a cinematographer, has asked a judge to dismiss her manslaughter charge.

Lawyer's for the 'Rust' weapons supervisor filed the motion in Santa Fe County claiming that prosecutors did not have the authority to file the involuntary manslaughter charge in the first place, that the investigation was 'sloppy' and improper, and that Gutierrez-Reed's due process rights were violated.

The tragedy occurred when actor Alec Baldwin, 65, pointed a gun during a rehearsal on the Western film set in October 2021, it fired, killing Halyna Hutchins, 42, and wounding the film's director Joel Souza.

Baldwin claims he never pulled the trigger and believed the gun to be 'cold' and therefore not to contain live ammunition. Baldwin has since sued Gutierrez-Reed and others for handing him the loaded firearm.

Gutierrez-Reed's motion to dismiss her involuntary manslaughter charges claims that the prosecution was 'tainted by improper political motives' and says that Santa Fe District Attorney Mary Carmack-Altwies and the initial special prosecutor she appointed, Andrea Reeb, 'both used the tragic film set accident that resulted in the death of Halyna Hutchins as an opportunity to advance their personal interests.'

Alec Baldwin allegedly 'yelled' at a female server at Thursday night's PEN America Literary Gala in NYC - leaving her 'shocked and upset', reports Page Six.

The actor, 65, who made his return to the red carpet after all charges were dropped against for accidentally shooting and killing cinematographer Halyna Hutchins on the set of Rust - is said to have become frustrated when the server began delivering meals to a table while he was stood up talking.

A source told the publication the incident unfolded when Baldwin stood to chat with someone a 'couple of minutes before the line of servers come all at once to deliver the meals.'

The server, said to be in her late 20s or early 30s, was allegedly stuck behind the actor as he was chatting, with the source saying: 'Then, when she could pass, she started putting plates on the table. I guess he didn’t like that she did that with him standing there.'

The actor is then said to have started 'scolding her' with the 'visibly upset' server overheard telling someone: 'I don't know why he yelled at me.'

Last week Page Six reported the actor, 65, who made his return to the red carpet after all charges were dropped against for accidentally shooting and killing cinematographer Halyna Hutchins on the set of Rust - became frustrated when the server began delivering meals to a table while he was on his feet chatting.

Now the female server has made fresh allegations to the publication about the actor's conduct during the night - claiming he was 'patronizing' and 'very agitated' as she attempted to do her job.

She said: 'I'm a sweep leader which means I basically tell the waiters when to put down the plates and we have to do it in a certain order.

'I was going to feed the head of the table but that’s who he was talking to, so I go up to him and I say, "I’m sorry sir, but we’re going to have servers walking through the tables here in a minute."'

She claims Baldwin 'patronizingly asked': 'So when is it a good time to talk to my friends?' - a reaction she 'did not expect' and said he became 'very agitated' before saying: 'Do I have to explain it to you?'

She said she did not want the situation to escalate so simply responded that he did not need to explain it - to which she claims he responded: 'Well then step aside.'

The server added: 'Afterwards, many of my co-workers came up to me and said, "Do you know what he said while you were walking away?" I didn’t catch it because I was focused on my work but apparently he was calling me a peasant [and] was clearly mad that I told him kindly, "Excuse me."'

Branding the star 'bitter', she said other stars, including Colin Jost, were polite towards her.

She added that she wasn't afraid about getting into trouble over the incident, saying: 'What could he say? I approached him nicely, I was basically doing my job

Actor Alec Baldwin could still face charges in the fatal shooting on the set of Rust, if forensic tests determine the gun involved did not malfunction, prosecutors in New Mexico have revealed.

Sorta good to hear. But come on, this is something that should have already been determined.
Also, to the many people familiar with guns on the forum, is it realistic or common for handguns to just go off? Think about it. If that were to become a precedent, it would be an incredible boon to people accused of killing with a handgun.

I am more than a little surprised they're still going on about this.

Modern handguns come with safety mechanisms that hold the firing pin in place away from the cartridge primer even if the weapon is dropped. 'Transfer bar' type safeties only fall out of the way when the trigger is deliberately pulled. But old Single Action Army revolvers like the one Baldwin used never had those to begin with.No, with that old Colt you don't carry six, only five. You load one, skip one, load four so the hammer rests on an empty chamber. Yes, you can fire it without the trigger if you have to as long as the spring is intact and yes, it could have malfunctioned. Any firearm can, it's just more likely on that original version. Cowboy action shooting is quite popular and other manufacturers like Ruger make handguns that look totally original but incorporate the transfer bars, some are historical replicas that are of modern manufacture but don't have them. I am assuming Baldwin's weapon is an original or one of the latter because if it did had that transfer bar then he pulled the trigger, period. Shouldn't be any equivocation.

On semi-auto handguns like the m1911A1 (my favorite) a Colt Series 80 has a plunger that holds the inertial firing pin in place where the original Series 70 does not. There are purists that will argue the presence of those safeties inhibits a good trigger pull and there may or may not be any merit to that. But even inherent, reliable mechanical common sense safeties like that are fodder for debate when the argument is extended to include 'smart' guns, special unlocking rings, the Hillary Hole etc.

I would like to see a criminal case happen, but Alec can outspend poor New Mexico no problem. Besides, he only has to convince one juror to acquit and then they have to do it all over again. The civil suit is really where the justice will happen, if you can call it that.

Lucien Haag and Mike Haag, who were commissioned by the prosecution, concluded that Baldwin had to pull the trigger of the gun in order for it to fire.

"Although Alec Baldwin repeatedly denies pulling the trigger, given the tests, findings and observations reported here, the trigger had to be pulled or depressed sufficiently to release the fully cocked or retracted hammer of the evidence revolver," the report, obtained by Fox News Digital, read. "This fatal incident was the consequence of the hammer being manually retracted to its fully rearward and cocked position followed, at some point, by the pull or rearward depression of the trigger."

Even if they ultimately do charge Baldwin, I don't have much confidence in the prosecution. This is such central issue regarding the incident that a competent department would have been "no comment" all the way until the facts had been ascertained. They seem either incompetent, or too influenced by the high profile aura of the case, or both.

I don't know, it's been a while, but something about the man always struck me as odd, you know? Over the years of observing Alec, what I saw in him was some sort of inflated or massive presence, like the personality or an out of hand class clown, always trying to get a spotlight for attention. I saw that in his personality as early as the betlegeause movie, but around the era where he spent a lot of time on Saturday night live parodying trump, there was something about his personality that had changed , there was genuine malice and bitterness in his portraial.

Consider for a moment , an unstable personality , filled with contempt , portraying a parody of a man he had genuine bitterness for, he acted out his malice, he literally in some sort of acting or practical or psychological sense became twisted in all that confusion and hate. I genuinely in my heart of hearts feel that the man's ego and disconnection from the spotlight drove the man to extremems for attention. That , or his ego was just so twisted and massive he wanted to see if he could get away with flat out murder...

Alternatively, I've considered that he had all this money and budget and resources on the line and contractual obligations to fill. I've considered this may be some sort of motive to the what I deam as a murder.. he may have perhaps because the budget was not depleted , he may have access to several hundred million dollars of money that's probably not his own...

I think there are a grand total of maybe 7 parts that make that revolver he used work so I doubt it'll tax the forensic skills of whoever is looking at it to determine exactly what condition the sear was in, which would determine whether Baldwin's claims have any basis in fact.

If a general contractor ran a slipshod job site that resulted in someone's death they'd be held responsible. In Connecticut there are a couple of examples of contractors being jailed for work their employees did under their license - at least that was the propaganda offered every year when I went to renew my own contractor's license. In the rare instances I had someone working with me under a permit I pulled with my own license you'd best be sure I made sure their work was acceptable. If he delegated these tasks and that's how the loaded gun wound up in his hand I could see him being liable in a civil not criminal case. Has anybody figured out who hired and supervised that young armorer?

If Baldwin had used some common sense and took a look at what may or may now have been loaded in the chamber, then maybe she would still be alive...I know I would have done that if someone handed me a weapon to look at or fire...I would check to see what was loaded if anything at all...
